1. Essential characteristics of the liza app
ruwido offers the option of downloading the liza app from the Google Play Store and the Apple Store and installing it on a mobile device. The app can be used to set up, configure and personalise the ruwido ‘liza’ remote control. The app is needed to operate ‘liza’, as ‘liza’ uses the smartphone as a hub.
2. Acceptance of Terms of Use
By installing and using the liza app (hereinafter ‘app’) for the first time and clicking the button ‘Agree to the Terms of Use’, the customer expressly agrees to these Terms of Use.
3. Use of the app
3.1 The customer can download the app free of charge. Data transfer charges of the network operator may be incurred in connection with using the app; these must be borne in full by the customer.
3.2 In order to use the app, it must be properly installed on the mobile device and the Terms of Use must be accepted.
3.3 ruwido grants the customer a non-exclusive, non-transferable and non-perpetual right to use the app in its respective current version (including updates and other components) in accordance with these Terms of Use for the duration of the contractual relationship.
3.4 The customer may not modify, copy, reverse engineer, publish, reproduce or duplicate the app. The customer is only permitted to use the app for their own purposes (use for commercial or business purposes is not permitted). The app may not be used by third parties.
4. Forfeiture of the rescission right pursuant to Art. 18 FAGG (Act on Distance Selling and Contracts; Fern- und Auswärtsgeschäfte-Gesetz)
After the app has been installed on the customer’s mobile device and the Terms of Use have been accepted, the app is ready to use. If the performance of a service is commenced at the customer’s request before the end of the 14-day time limit for rescission under Art. 11 FAGG, the rescission right shall be forfeited after the customer has been legally informed of these consequences of early performance.
The customer hereby acknowledges and expressly agrees that, when they use the app for the first time, ruwido is performing the service before the end of the time limit for rescission pursuant to Art. 11 FAGG, which means that the rescission right is forfeited according to Art. 18 FAGG.
5. Support
5.1 ruwido offers support for the app on its website https://i-am-liza.com/faq and by email (support@i-am-liza.com).
5.2 Information about the app’s interoperability with hardware and software is provided on the website at https://i-am-liza.com/faq.
6. Liability
6.1 ruwido accepts no liability for damage and loss caused by the use or non-use of provided information or by the use of incorrect or incomplete information, unless it was caused by intentional or grossly negligent behaviour on the part of ruwido.
6.2 ruwido offers no warranty for faults, malfunctions or damage attributable to incorrect use.
6.3 The limitations of liability set out in Art. 6.1 do not apply for damages arising from death, physical injury or impairment of health, nor do they apply if they are contradicted by mandatory legal provisions or essential contractual obligations.
7. Links
The app may contain links to third-party websites or other apps. ruwido has no control over these and accepts no responsibility or liability for linked content and external offerings.
8. Duration and termination
8.1 The contractual relationship is concluded for an indefinite period.
8.2 The customer has the right to terminate the contractual relationship at any time without having to observe a notice period.
8.3 ruwido has the right to terminate the contractual relationship by providing two months’ notice. Furthermore, ruwido is entitled to terminate the contractual relationship with immediate effect for good cause, which includes in particular a violation of the Terms of Use.
9. Data protection
9.1 ruwido is obliged to comply with the provisions of DSG (Data Protection Act; (Datenschutzgesetz), GDPR (General Data Protection Regulation) and any other legal confidentiality obligations.
9.2 ruwido processes the personal data that is needed for the purpose of performing the contract. Detailed information about data protection (Privacy Policy) pursuant to Art. 13 et seq. GDPR can be found on our website at https://i-am-liza.com/de/datenschutz.
10. Changes to the Terms of Use
ruwido is entitled to adapt and change the Terms of Use should this be necessary due to new laws, jurisdiction or technical reasons.
11. Final provisions
11.1 This contract is subject to relevant Austrian law, under exclusion of conflict of law rules of private international law (e.g. Rome Convention, ROM I Regulation) and the UN Convention on Contracts for the International Sale of Goods. This choice of law shall only apply to consumers to the extent that it does not limit any mandatory legal provisions of the province in which the consumer has their domicile or ordinary residence.
11.2 Any disputes shall be presided over exclusively by the competent court in the local jurisdiction where ruwido has its registered office. For contractual relationships with consumers within the meaning of the Consumer Protection Act (Konsumentenschutzgesetz), the aforementioned provisions apply to the extent that they are not contradicted by other provisions under consumer protection law.

5. Liability
5.1 ruwido accepts no liability for damage and loss caused by the use or non-use of provided information or by the use of incorrect or incomplete information, unless it was caused by intentional or grossly negligent behaviour on the part of ruwido. In other cases, ruwido is only liable (unless governed otherwise in 5.3) in the event of a breach of a contractual obligation, the fulfilment of which is essential to enable the proper performance of the contract in the first place (‘essential obligation’); this liability is limited to compensation for foreseeable and typical damage.
5.2 ruwido offers no warranty for faults, malfunctions or damage attributable to incorrect use.
5.3 ruwido’s liability for damages arising from death, physical injury or impairment of health and under the Product Liability Act (Produkthaftungsgesetz) shall not be affected by the aforementioned limitations and exclusions of liability.

5.1 To the extent permitted by law, ruwido accepts no liability whatsoever (including liability for slight negligence and accidents, liability for consequential damage/loss such as lost profits, liability for vicarious agents) in connection with using the app. Furthermore, ruwido accepts no liability for the completeness, accuracy or availability of information in the app and/or the stability of the app. In addition, ruwido accepts no liability for manipulation of the app user’s device by third parties. The same applies in the event of unlawful interference with data transmission or processing or with the mobile device. Finally, ruwido accepts no liability for the correct and complete use of the app on devices for which the manufacturer’s security measures have been reduced or deactivated.
5.2 In particular, ruwido offers no warranty for faults, malfunctions or damage attributable to incorrect use.
